Analysis of a Movie Actor's Use of the Marriage and Divorce Expressions in Islamic Family Law


PhD student at KTMU Faculty of Theology Aysuluu ADILBEK KIZI gave an academic seminar titled “Analysis of a Movie Actor's Use of the Marriage and Divorce Expressions in Islamic Family Law” on Tuesday, December 24, 2024 at 10:00 am. The seminar was attended by the Dean of the Faculty of Theology Prof. Dr. Hasan AYIK, Advisor to the Rector Prof. Dr. Kemal Polat, academic and administrative staff. The speaker stated that in Islamic law, a person's inner intention must be clearly expressed verbally in order to have legal validity, and in this context, the marriage and divorce expressions uttered by movie actors as required by the script do not carry inner intention and do not have legal consequences because they are only portraying a role. While modern Islamic jurists evaluate this situation in two different ways, they argue that if the actor's words are likened to the words of marriage and divorce uttered as a joke, these words can have legal consequences as the Prophet said, “There are three things: The serious is serious and the joking is serious; He stated that they based their statements on the hadith “these are marriage, divorce and ric‘at (return to spouse after divorce)”. Others, on the other hand, considered the actor’s words as a suggestion of the scriptwriter and that these words have no legal validity and that, according to them, the words spoken by the actor are part of the scriptwriter’s text and the actor had no intention of saying these words. Therefore, he concluded his speech by saying that the actor’s words of marriage or divorce are invalid.
At the end of the seminar, the Dean of the Faculty of Theology Prof. Dr. Hasan AYIK and the Rector’s Advisor thanked the speaker for her contributions and presented her with a certificate of participation.
